This website is operated by Jasmim Design, Lda. Hereinafter the terms "we", "us" and "our" refer to Jasmim Design, Lda.

By visiting our website and/or purchasing a product, you are using our “Services” and, consequently, you agree to the following “Terms and conditions”, including the additional terms and conditions and policies mentioned in this document and/or available via link.

We reserve the right to update, change or replace any part of these terms of service by posting updates and/or changes to our website. It is the responsibility of the consumer and/or visitor, hereinafter referred to as “user”, to periodically check the changes made to this page.

 

1.1 CONTENT

Jasmim Design, Lda. is the owner of the domain of this website www.jasmimdesign.com , as well as all content, including photographs, texts, logos, images and video material. The reproduction or use of these elements by third parties is not permitted. All content on the website is protected by copyright and by national and international legislation for the protection of Intellectual Property.

 

1.2 CONTACTS THROUGH FORMS:

The information entered by the user in the form on the contact page and in the various text boxes, such as on product pages with personalization, is the sole responsibility of the user. The user must not enter offensive or false information. The use of the website and associated services implies acceptance of the terms and conditions of use and the privacy policy by the user.

 

1.3 COMMENTS, FEEDBACK AND OTHER USER INTERACTIONS

If, at our request, you take certain specific actions or, without a request from us, you send creative ideas, suggestions, proposals, plans, or other materials, whether online, by email, by postal mail, or otherwise (collectively referred to as "comments"), you agree that we may, at any time, edit, copy, publish, distribute, translate and use, in any medium, any comments you forward to us.

You further agree that your comments do not violate any right of any third-party, including copyright, trademark, privacy, personality or other personal or proprietary right. You further agree that your comments do not contain defamatory or illegal material, and do not violate any other personal or proprietary rights.     When completing your order, you accept the general purchase conditions, as well as other conditions existing at www.jasmimdesign.com, through links, including the general conditions and terms of use.

     

    2.1 - CONTACT

    The user must provide us with an email address, or details relating to another form of contact, that are correct and complete, and accept that we can contact you using these details, should the need arise.

     

    2.2 - PRODUCTS OR SERVICES

    We make every effort to display the colors and images of our products in our online store as accurately as possible. We cannot guarantee that your computer monitor's display of any color will be accurate.

    Jasmim Design, Lda. does not sell defective products or products of inferior quality to the standards existing on the market. You can find the characteristics of each product on each respective product page.

    Some products or services may have limited quantities and may not be eligible for return or exchange in accordance with our Return Policy. For more information, please see our Returns Policy (point 3).

     

    2.3 - ACCURACY OF BILLING AND ACCOUNT INFORMATION

    Jasmim Design, Lda. reserves the right to refuse any order. We also reserve the right to cancel any purchase (even if it has already been accepted by us), (among others) in the following situations, exempt from liability for any damages or costs:

     

    1. The product is no longer available/in stock (payments will be refunded);
    2. Billing information is not correct or verifiable;
    3. The order is flagged by our Security Systems as an incorrect order or an order susceptible to fraud;
    4. The transfer for payment of the order was not received by us within 5 days after accepting your order;
    5. If we think you are under 16;
    6. Unable to deliver to the address provided.

    In these cases, we will inform you by email that the sales contract has not been concluded and that we will not proceed with the sale, specifying the reasons for this.

    If an order has been placed and payment has been made for products that are no longer available, we will refund the money paid for the unavailable items within 15 working days.



    2.4 - PROCESSING AND DELIVERY CONDITIONS

    In the event that we make a change to or cancel an order, we will notify you by contacting the email address and/or phone number/billing address provided at the time the order was made. You agree to provide your complete account and purchase information for all purchases made at our store, and you agree to promptly update your account and other information, including your email address, credit card numbers and expiration dates , so that we can complete your transactions and contact you when necessary.

    You can pick up your order directly from our studio, without shipping costs, at the following address, by appointment:

    Or prefer shipping via Carrier or CTT, with an additional shipping cost (to be defined based on the weight and volume of your order and destination address), this cost will be informed to you at the time of ordering or, for personalized services, after we receive the order.

    The value calculated for postage may change if the order is changed, namely: changes in dimensions or weight, or require another service such as collection.

    The processing/execution time for orders is 3 days to 4 weeks (for more information, contact us by email to find out the estimated time for the desired order). After dispatch of the order, delivery is made within 24/48 working hours in mainland Portugal, between 9am and 7pm, on business days from Monday to Friday.
    In the event of delays occurring in relation to the agreed delivery times, due to causes beyond the control of Jasmim Design, Lda. (eg delays on the part of suppliers, lack of raw materials on the national market, delays by the carrier) there will be no right compensation in favor of customers.

    We do not guarantee this period during periods of promotions, sales, Christmas, periods of epidemics or in the event of stock outs.

     

    2.4.1. Inspection upon delivery

    Upon delivery, the customer must inspect the packaging to check for any damage. If the products are found to be damaged, the customer must not accept delivery of the order, which will be returned. Within the next 24 hours you should contact us using the contact form to inform us of the problem. Jasmim Design, Lda. will refund the amounts paid for the order and transportation, as soon as it receives and completes the return process.

    Any complaint about non-receipt of an order must be made within a maximum period of 30 days from the date of placing the order. After this deadline, Jasmim Design, Lda. cannot be held responsible for the loss of the item.

     

    2.5 PAYMENT METHODS

    You can find the payment methods available in the Payment Methods section of the website. We do not accept any other payment methods other than those mentioned. Please do not attempt to pay by any other means than specified. If you do so, we cannot be held responsible for loss of payment or any other damages that may arise.

     

    2.6 PRICES
    2.6.1 The prices of products displayed on the website contain/include Added Value (VAT). Shipping fees apply per order.

    2.6.2 Prices are all quoted in euros.

    2.6.3 Prices for our products and services are subject to change without prior notice. We reserve the right, at any time, to modify or discontinue the Service and/or Product (or any part or content thereof) without prior notice.



    1. RETURN POLICY

    3.1. EXCHANGES AND RETURNS

    Personalized goods/products or products developed from scratch for the consumer, sold through the services of Jasmim Design, Lda., such as invitations, illustrations and all products with any type of personalization, are not included in the right to repentance, and therefore are not subject to make exchanges or returns. This situation is provided for by law. Information regarding the consumer's (private customer) right to terminate the contract is described in detail in Decree-Law No. 143/2001 and Decree-Law No. 82/2008.

    The client is given the possibility of exercising the right to freely terminate the contract within 14 days after its conclusion/signaling, if the proposal has not yet been initiated by Jasmim Design, Lda.

    For this purpose, you must use the email: info@jasmimdesign.com and take into account that if the design or finishing process has already started, it is not possible to cancel or change the order.

     

    In the case of providing personalized graphic design services - invitations, stationary, branding - the design process begins after payment of 50% of the amount agreed between both parties, via meeting or email.     3.2 Cancellation of the order before shipping

    The customer can cancel the order, as long as it is not a personalized product and it has not yet been shipped. If the customer places an order and wishes to cancel it, they must contact our Customer Service and request the cancellation of their order, via the email address info@jasmimdesign.com

    If the cancellation request is successful, the customer will be notified by email of this decision and the cancellation will be processed at no cost to the customer.

     

    3.3 Return of defective products

    The customer has the right to return the delivered products if they are found to have defects or other non-conformities in relation to the products ordered. Returns can be made within 30 days of receiving the order. If your complaint is justified, the price and shipping costs will be refunded.

    Certain content, products and services available through our Service may include materials from third parties. Third-party links on this site may direct you to third-party sites that are not affiliated with us. We are not responsible for examining or evaluating the content of these sites or their accuracy.     1. ENTIRE AGREEMENT

    These Terms govern your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service). Any ambiguities in the interpretation of these Terms of Service shall not be construed against the drafting party.

    These general conditions and all emerging disputes that are related to these general conditions, including their validity, the use of the website or any purchase on it must be governed by Portuguese Law.
